Fulshear City Council will consider a new economic development deal with Home Depot on Tuesday, Sept. 15. The vote comes six weeks after council rejected a similar agreement 5-1.
The Home Depot item is one of several high-profile items at the 6 p.m. meeting at the Fulshear Municipal Complex, 6611 W. Cross Creek Bend Lane. Council will also consider a water supply agreement with North Fort Bend Water Authority, two specific use permits and a discussion on the employment of the chief of police.
Home Depot returns
Council denied a Chapter 380 economic development agreement, a tax incentive tool available to Texas cities, on Aug. 4 after Home Depot declined the city's request to conduct a traffic impact analysis for its planned roughly 134,000-square-foot store near FM 1093 and FM 1463, Covering Katy reported. Council Members Kimberly Bow, Randy Connor, Sarah B. Johnson, Camron K. Miller and Omar Peña voted to deny. Richard Russell voted against the denial. Abhijeet Utturkar was absent.
The rejected deal would have returned 25% of Fulshear's 1% local sales tax generated by the store for up to five years. Payments were capped at $2 million, though city staff estimated the actual incentive closer to $500,000. Home Depot proposed an investment of more than $38 million and at least 40 full-time jobs.
Assistant City Manager Kelsee Lee told council on Aug. 4 that Home Depot is exempt from the traffic study requirement under existing development agreements tied to Cross Creek Ranch. Lee said the study could only be negotiated as part of an incentive agreement.
"I would have respected the 380 if we had a traffic impact analysis," Mayor Pro-Tem Johnson said at the Aug. 4 meeting. "I think it is quite a busy area to get busier."
The terms of the revised agreement on the Sept. 15 agenda have not been made public.
Water, telecom, liquor store
Council will consider a water supply agreement with North Fort Bend Water Authority (NFBWA). The council discussed the authority in executive session at a Sept. 1 special meeting but took no action. The specific terms of the proposed agreement are not available in the published agenda packet.
Two public hearings are scheduled. One covers a specific use permit for a telecommunications tower at 27500 Fulshear Bend Drive in the Semi-Urban Residential District (Ordinance No. 2026-1549). The other covers a specific use permit for a retail liquor store at 8526 FM 359 in the Downtown District (Ordinance No. 2026-1548). The Planning and Zoning Commission held hearings on both permits Sept. 4.
Police chief, other items
The agenda includes discussion and possible action on the employment of the chief of police. The nature of the discussion is not specified.
In May, Fulshear voters approved a sales tax reallocation that shifted 0.25% from the Fulshear Development Corporation to the city's General Fund to support police compensation improvements.
The consent agenda includes Houston Methodist naming rights for Primrose Park Amphitheater and a $169,500 John Deere tractor purchase from Shoppa's Farm Supply.
Three development ordinance amendments covering estate residential lot regulations, stormwater management and wildlife impact analysis are also scheduled for consideration. Residents can register to speak during the citizen comments period at the start of the meeting.
